Terms of Use

Please read these Terms of Use carefully before accessing or using any part of the Optionflare platform available at optionflare.vip. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Definitions

The following terms apply throughout this document:

  • Platform refers to the website, tools, communication interfaces, and any related digital services operated under optionflare.vip.
  • Service refers to online consultation, planning assistance, and related offerings made available through the Platform.
  • User refers to any individual or entity accessing or using the Platform.
  • Account refers to a registered profile created by a User to access personalised features of the Platform.
  • Content refers to any text, images, data, files, or other material submitted to or displayed on the Platform.
  • We, Us, Our refers to Optionflare and its authorised representatives.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
  • You have the legal capacity to enter into a binding agreement.
  • Your use of the Platform does not violate any applicable law or regulation.
  • You are not accessing the Platform on behalf of any person or entity who is prohibited from doing so under applicable law.

3. Account Registration and Security

3.1 Creating an Account

Certain features of the Platform require registration. When creating an Account, you agree to provide accurate, current, and complete information and to keep that information updated at all times.

3.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials. Any activity conducted through your Account is your responsibility. You must notify us immediately at help@optionflare.vip if you suspect unauthorised access to your Account.

3.3 Account Termination

We reserve the right to suspend or permanently terminate any Account that we reasonably believe is being used in violation of these Terms, without prior notice.

4. Use of the Platform

4.1 Permitted Use

You may use the Platform solely for lawful purposes and in accordance with these Terms. Permitted uses include accessing consultation services, communicating with assigned specialists, and managing your event planning requests.

4.2 Prohibited Conduct

You must not:

  • Use the Platform for any fraudulent, deceptive, or unlawful purpose.
  • Transmit unsolicited commercial communications or spam.
  • Attempt to gain unauthorised access to any system, network, or data connected to the Platform.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Platform.
  • Upload or transmit viruses, malware, or any other harmful code.
  • Scrape, crawl, or systematically extract data from the Platform without express written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure.
  • Use the Platform to collect personal data of other Users without their consent.

5. Consultation Services

5.1 Nature of Services

Optionflare provides online consultation and planning assistance for weddings and private celebrations. Services are delivered remotely via the Platform's communication tools. All consultations are advisory in nature and do not constitute a guarantee of any specific outcome.

5.2 Service Availability

We make reasonable efforts to ensure the Platform is available at all times. However, we do not warrant uninterrupted or error-free access. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability.

5.3 Specialist Assignment

We reserve the right to assign, reassign, or substitute any specialist at our discretion in order to maintain service quality.

6. Fees and Payments

6.1 Pricing

Applicable fees for services are displayed on the Platform at the time of booking or subscription. All prices are inclusive of applicable taxes unless stated otherwise.

6.2 Payment Obligations

Payment is due at the time of purchase unless a different arrangement is expressly confirmed in writing. You authorise us to charge the payment method provided for all fees incurred.

6.3 Refunds

Refund eligibility is determined in accordance with our Refund Policy, which forms part of these Terms. We reserve the right to decline refund requests where services have been fully rendered or where misuse has been identified.

6.4 Failed Payments

If a payment fails, we may suspend access to your Account until the outstanding balance is resolved. Continued non-payment may result in permanent Account termination.

7. Intellectual Property

7.1 Our Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, interface design, software, and documentation, is the exclusive property of Optionflare or its licensors and is protected by applicable intellectual property laws. No licence to use our intellectual property is granted except as expressly stated in these Terms.

7.2 User Content

By submitting Content to the Platform, you grant Optionflare a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display that Content solely for the purpose of delivering the Service to you. You retain ownership of your Content and are solely responsible for its accuracy and legality.

7.3 Restrictions

You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

8. Privacy and Data

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, processing, and use of your personal data as described in that policy. We handle all personal data in accordance with applicable data protection standards.

9. Third-Party Services and Links

The Platform may contain links to or integrations with third-party websites, tools, or services. These are provided for convenience only. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are governed by their own terms and policies.

10. Disclaimers

10.1 No Warranty

The Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Accuracy of Information

We do not warrant that information provided through the Platform is complete, accurate, or up to date. You should independently verify any information before relying on it for significant decisions.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Optionflare and its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform or Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the total amount paid by you to us in the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Optionflare and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any rights of another person or entity.

13. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. If changes are material, we may provide additional notice through the Platform or via email. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

14. Suspension and Termination

We may suspend or terminate your access to the Platform at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other Users, us, or third parties. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

15. Governing Terms

These Terms represent the entire agreement between you and Optionflare with respect to your use of the Platform and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
